This website, gibbzymart.com, is operated by Entarch Consulting, a registered business in Ontario, Canada.  Throughout the site, the terms “we,” “us,” and “our” refer to Entarch Consulting, operating GibbzyMart.

GibbzyMart provides this website, including all information, tools, and services available to you, conditioned upon your acceptance of these Terms of Service (“Terms”). By visiting gibbzymart.com, browsing the site, or making a purchase, you agree to be bound by these Terms as well as our Privacy Policy. If you do not agree to these Terms, you may not access the website or use any of the Services.

Section 1 – Access and Account

By using our Services, you represent that you are at least the age of majority in your state or province of residence. You agree to provide accurate, current, and complete information when creating an account or making a purchase. You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

Section 2 – Our Products

We strive to accurately represent all products and services available through our website.  However, due to screen settings and device variations, actual colors or appearances may differ slightly from those shown.  All descriptions, pricing, and availability are subject to change without notice. We reserve the right to discontinue any product at any time or limit quantities offered.

Section 3 – Orders

When you place an order with gibbzymart.com (operated by Entarch Consulting), you are making an offer to purchase.  We reserve the right to accept or decline any order at our discretion. An order is accepted only once payment is processed and confirmation is issued.  Please review all orders carefully before submitting, as cancellations may not be possible after confirmation.  Returns and refunds are governed by our Returns & Refund Policy 

All purchases are for personal or household use only and not for resale or export.

Section 4 – Prices and Billing

All prices, discounts, and promotions are subject to change without notice.  The price in effect at the time of purchase will be reflected in your confirmation email.  Unless stated otherwise, prices exclude taxes, shipping, and handling.  You agree to provide accurate and up-to-date billing information and authorize us to charge the payment method provided for your purchases.

Section 5 – Shipping and Delivery

GibbzyMart ships to the 48 contiguous United States. Shipping is not available to Alaska, Hawaii, Puerto Rico, or U.S. territories.  Free standard shipping is provided on all eligible orders. Delivery times are estimates and may vary. Once your order has been transferred to the carrier, responsibility for the shipment transfers to you.   Refer to our Shipping Policies for details. 

Section 6 – Intellectual Property

All trademarks, trade names, images, text, graphics, and other content on gibbzymart.com are owned or licensed by Entarch Consulting, the operator of GibbzyMart, and are protected by applicable copyright, trademark, and intellectual property laws.  You may not copy, reproduce, modify, or distribute any part of the Services without our prior written consent.  All rights not expressly granted in these Terms are reserved by GibbzyMart and its licensors.

Section 7 – Optional Tools and Third-Party Services

Our site may provide access to third-party tools or links that we do not control.  These tools are provided “as is” and without warranties.  We are not responsible for any third-party materials, content, or services accessed through our site.

Section 8 – Relationship with Shopify

gibbzymart.com is powered by Shopify, which provides the online e-commerce platform that enables us to offer and sell products and services to you. However, your sales contract is solely with Entarch Consulting, the operator of GibbzyMart. Shopify is not responsible for any part of your transaction, your purchase, or for resolving any disputes related to your order.

Section 9 – Privacy Policy

Your submission of personal information through the store is governed by our Privacy Policy.  Because our Services are hosted by Shopify, your information may also be subject to Shopify’s Privacy Policy, available at https://www.shopify.com/legal/privacy.

Section 10 – Feedback and User Content

Any feedback, suggestions, or reviews you submit to gibbzymart.com may be used for promotional or operational purposes.   By submitting such feedback, you grant us a non-exclusive, royalty-free, worldwide license to use and display that content.  We reserve the right to remove or edit user submissions that violate these Terms or applicable laws.

Section 11 – Errors and Omissions

Occasionally, information on our site may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, or availability.
We reserve the right to correct these errors and update information at any time without prior notice.

Section 12 – Prohibited Uses

You agree not to misuse the Services, including but not limited to engaging in illegal activity, transmitting malware, harvesting personal data, or infringing upon intellectual property rights.  Any unauthorized use may result in termination of access to our site and potential legal action.

Section 13 – Termination

We may suspend or terminate your access to our Services at any time for violations of these Terms or for any other reason deemed appropriate in our discretion.
Sections concerning Intellectual Property, Limitation of Liability, and Governing Law will survive termination.

Section 14 – Disclaimer of Warranties

Except as expressly stated by GibbzyMart, the Services and all products offered through gibbzymart.com are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of defects, nor do we guarantee the accuracy or reliability of any information provided through the Services.

Section 15 – Limitation of Liability

To the fullest extent permitted by law, Entarch Consulting, the operator of GibbzyMart, and its officers, employees, agents, affiliates, and suppliers shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services or any products purchased. This includes, without limitation, lost profits, loss of data, business interruption, or any damages arising from your reliance on information provided through the Services.

Section 16 – Indemnification

You agree to indemnify and hold harmless Entarch Consulting (operator of GibbzyMart), Shopify, and their respective officers, employees, agents, and affiliates from any claim or demand, including reasonable attorney fees, that arises from your breach of these Terms, your violation of any law, or your infringement of the rights of any third party.

Section 17 – Governing Law

These Terms of Service and any related transactions are governed by and construed in accordance with the laws of the Province of Ontario, Canada.  You and Entarch Consulting consent to the exclusive jurisdiction of the courts located in Ontario, Canada.

You can review the most current version of these Terms of Service at any time on this page.   We reserve the right to update or modify these Terms at our discretion. Changes take effect once posted on the website. Your continued use of the Services following any updates constitutes acceptance of those changes.
